Fisher, Unions, - SCOTUS after Scalia.

SCOTUSblog's Tom Goldstein breaks down how Justice Scalia's death will impact the outstanding cases in the Supreme Court.


Conversely, the Court was likely to limit affirmative action in public higher education in the Fisher case. But because only three of the liberal Justices are participating (Justice Kagan is recused), conservatives would retain a narrow majority.

On appointing or not appointing his successor/replacement in 2016-hypothetical- What if we have a Bush v. Palm Beach situation or Bush v. Gore scenario at the end of this year with an eight member 4-4 SCOTUS left to decide it?

What if, another hypothetical, midyear one or two of the Supremes also decide to retire effective immediately--still no executive appointments, confirmations this year, just cuzzz?
